Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Melodynk. They govern your use of Melodynk.com and every digital artwork you license from us. Please read them before you buy.

1. Who we are

Melodynk.com (“Melodynk,” “we,” “us,” “our”) is a digital art workshop and online store. We create original digital artworks and sell downloadable digital art files. All artworks on Melodynk.com are created by us.

Registered address: 169 Madison Ave STE 15155, New York, NY 10016, United States.

2. How you accept these Terms

You accept these Terms when you check the acceptance box at checkout, create an account, or place an order — whichever happens first. Using the website also constitutes acceptance, but every purchase requires your affirmative acceptance at checkout before payment.

We keep a record of each acceptance, including the date, time, and the version of the Terms you accepted. If you do not agree to these Terms, do not use the website or purchase our products.

3. Eligibility and your account

You must be at least 18 years old and legally able to enter a binding contract to make a purchase. You may need an account to purchase or download files. You agree to provide accurate information, keep your login credentials confidential, and take responsibility for activity under your account. We may suspend or close accounts that violate these Terms or the law.

4. What you are buying: a license, not ownership

When you buy an artwork on Melodynk.com, you are buying a license to use a digital file. You are not buying the artwork itself, its copyright, or any ownership interest. Words such as “buy,” “purchase,” and “sale” on this website refer to the purchase of that license.

Your license is personal, non-exclusive, non-transferable, non-sublicensable, and worldwide. It can be revoked only if you violate these Terms, which means your continued access to a purchased file depends on your compliance with them. What the license allows and forbids is set out in Sections 7 and 8.

5. Orders, pricing, taxes, and payment

Your order is an offer to license the file. We accept it when payment is processed and the download is made available. Prices are in US dollars (USD) unless stated otherwise and may change for future purchases at any time. We may cancel an order and refund its payment if a price or description contains an obvious error, and we may decline or cancel an order before acceptance if we reasonably suspect fraud or abuse. Taxes we are required to collect are shown at checkout; any other taxes or duties under your local law are your responsibility.

Payments are processed by third-party providers such as Stripe, and we never store your payment card details. By paying, you accept the provider’s terms and confirm you are authorized to use the payment method.

6. Delivery and ongoing access

Your file is delivered immediately after successful payment: we send a confirmation email with a secure link, and the file becomes available for download in your account dashboard. You are responsible for keeping your email address accurate and able to receive our messages.

Purchased files remain available in your account dashboard. If you ever lose access, contact us and we will restore your access or issue a new download link. We recommend downloading your files promptly and keeping your own backup copies. Closing your account ends your dashboard access, so download your files before you close it.

7. What you may do (permitted uses)

Under your license, you may:

  • download the file to your personal devices
  • keep a reasonable number of backup copies for your own use
  • display the artwork on your personal devices and screens
  • print the artwork and display your prints at home, in your office, or at your own workspace; displaying the artwork in business premises that host customers or an audience, such as hotels, restaurants, shops, or event spaces, requires a commercial license (Section 8)
  • use a third-party print service that prints privately for you to produce your personal prints, sharing the file with that service only as needed for printing; print-on-demand marketplaces and any platform that lists, displays, or offers the artwork to others are not permitted
  • apply the artwork to personal items such as clothing, footwear, accessories, or household items, provided the items are for your own use, are never sold, and are never used to promote a business or product
  • give a printed copy to another person as an occasional personal gift for private, non-commercial display; this does not cover printing copies for distribution, and the digital file itself remains licensed to you and may not be transferred

Any use not expressly permitted in this section requires our prior written consent.

8. What you may not do (prohibited uses)

Except as expressly permitted in Section 7, you may not, without our prior written permission:

  • share, gift, lend, sell, or otherwise provide the file to any person or entity
  • upload the file to any website, marketplace, platform, social network, file-sharing service, or cloud folder where others can access it
  • use the artwork for any commercial purpose, including advertising, marketing, branding, packaging, or products for sale
  • sell prints, merchandise, or any physical or digital product that includes the artwork
  • include the artwork in design packs, templates, themes, or similar products
  • modify, adapt, or combine the artwork to create anything for sale or distribution, or present the artwork or a derivative of it as your own work
  • create or promote NFTs or similar blockchain items using the artwork
  • use the artwork in violation of Section 9 (text and data mining, AI training)
  • remove, obscure, or alter any signature, notice of authorship, or protection measure, or attempt to bypass any technical protection
  • use automated tools to access, scrape, or copy our website or content

For commercial licensing — interiors, hospitality, galleries, brands, or products — contact us to arrange a separate written license.

9. No text and data mining. No AI training.

Melodynk expressly reserves all rights in the content of this website and in every digital file we sell for purposes of text and data mining and artificial intelligence. This is an express reservation of rights under Article 4(3) of Directive (EU) 2019/790 and equivalent laws elsewhere, and it is also expressed in machine-readable form on this website.

To the fullest extent permitted by law:

  • no person, company, or automated system — including crawlers, scrapers, bots, and data-collection tools — may reproduce, extract, scrape, or mine any content from this website or any Melodynk file for text and data mining of any kind
  • no Melodynk content or file may be used to train, fine-tune, test, validate, or otherwise develop any artificial-intelligence or machine-learning model or system, whether generative or not, whether commercial or non-commercial

Lawful access to this website or to a purchased file does not include access for these purposes. Any such use requires a separate written license from Melodynk.

10. File protection

Every file includes invisible digital protection. It does not affect the artwork’s appearance or print quality. It helps us trace unauthorized copying, redistribution, or resale. By purchasing, you acknowledge this protection and agree not to remove, alter, or attempt to defeat it.

11. If your file is defective

Our remedy for a defective file is to fix it, not to refund it.

A file is defective only if it is objectively faulty: corrupted, incomplete, unable to open in standard image software, or materially different from its product description — for example, the wrong file or a lower resolution than stated.

The following are not defects and do not qualify for any remedy: differences in color or brightness between screens or between screen and print; the quality of prints made by you or your print service; incompatibility with unusual software or devices; and dissatisfaction with the artwork’s style or appearance, which is shown on the product page before purchase.

If you believe your file is defective, contact us within a reasonable time of purchase and cooperate with us to confirm the issue, including reasonable checks of your software or device where relevant. We will bring the file into conformity, normally by providing a replacement file or restoring your access, free of charge and within a reasonable time. A conforming replacement or restored access fully resolves the claim.

Only if we cannot bring the file into conformity within a reasonable time are you entitled, where consumer law so provides, to an appropriate price reduction or a refund. Nothing in these Terms limits statutory remedies your law does not allow to be waived, including under Directive (EU) 2019/770 in the EU and the Consumer Rights Act 2015 in the UK.

12. All sales final; right of withdrawal

All sales are final. Files are delivered immediately, so once a file has been downloaded or accessed there are no refunds, exchanges, or cancellations for change of mind or dissatisfaction. The only paths after purchase are Section 11 (defective files), a billing error, or a right your local law does not allow you to waive.

If you were charged in error, contact us and we will refund the incorrect charge.

All requests go through our contact page. Any accommodation we choose to make in an individual case is voluntary, at our sole discretion, and does not change this policy or create a right in any other case. We may refuse requests that are abusive or repeated.

All sales being final also means payment must remain final. If a payment is reversed or charged back while you keep or continue to use the file, your license to that file is suspended until the payment is resolved, and we use our acceptance and delivery records to dispute improper reversals. Contact us before contacting your bank — a support request resolves faster than a payment dispute.

If you are a consumer with a statutory right of withdrawal for digital content (for example, in the EU or UK): at checkout you give your prior express consent to immediate delivery and acknowledge that you lose your right of withdrawal once the download or access of the digital content begins. Delivery begins only after you give this consent, and we confirm your consent and acknowledgment in your order confirmation email. Nothing in this section limits rights that your local law does not allow you to waive.

13. Intellectual property

All artworks, images, designs, text, logos, and other content on Melodynk.com are protected by copyright, trademark, and other intellectual property laws. All rights belong to Melodynk and/or its creators. Purchasing a license transfers no ownership. We reserve every right not expressly granted in these Terms.

14. Inspiration and third-party works

Our art is inspired by music, poetry, literature, and biblical and other spiritual texts. We claim no rights in any third-party song, poem, text, or other work that inspires our art; our rights apply only to the original artworks we create. You are responsible for ensuring that any combination of our artwork with third-party content respects the rights of others.

15. Reviews and feedback

If you submit reviews, comments, suggestions, or other content, you confirm you have the right to do so and that it violates no one’s rights. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, adapt, display, and share that content for our business purposes. We may remove any submitted content at our discretion.

16. Suspension and termination

If you violate these Terms, we may suspend or close your account and revoke your license to some or all purchased files. If your license is revoked for violation, you must stop using the artwork and delete your copies, and no refund is due. Sections 8 through 10, 13, 14, and 16 through 22 survive any termination; for files whose license was not revoked, Sections 4, 7, and 8 continue to apply.

17. Disclaimers

The website, its content, and our digital products are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free operation, or compatibility with every device. If we permanently discontinue the website, we will make reasonable efforts to notify you in advance so you can download your purchased files. Nothing in this section limits any warranty or protection your law does not allow to be excluded.

18. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim will not exceed the amount you paid for the specific product involved. This limit does not apply to liability that cannot be limited by law — including your non-waivable statutory consumer rights and, where applicable, liability for fraud or for death or personal injury caused by negligence.

19. Indemnification

To the extent permitted by law, you agree to compensate Melodynk for losses, costs, and expenses arising from third-party claims caused by your violation of these Terms or of someone else’s rights.

20. Governing law and disputes

These Terms are governed by the laws of the State of New York and the federal laws of the United States, and disputes will be brought in the courts of New York County, New York. If you are a consumer whose local law gives you mandatory protections or the right to bring or defend claims in your home courts, those protections and rights remain yours.

21. Changes to these Terms

We may update these Terms. Changes take effect when posted with an updated effective date, and material changes will be notified on the website or by email. Each purchase is governed by the version of the Terms you accepted at that checkout.

22. General terms

If any part of these Terms is found invalid, the rest remains in effect. These Terms are the entire agreement between you and Melodynk about the website and our products. We may assign these Terms as part of a business transfer; you may not assign your license or these Terms. If we do not enforce a provision, we do not waive it. Section headings are for convenience only.
